These are important topics for accident victims to understand. First, Georgia law allows for a victim to potentially recover damages even if they were partially at fault for the accident. A victim’s recovery will be reduced by their share of the fault. Second, the discovery process can be used to prove that a party was driving while engaging in distracting conduct (such as texting). Third, dealing with insurance adjusters can be a lengthy process and it is important that one not accept a “low ball” settlement. Fourth, it may be some time before a case is filed due to the fact that a victim’s future prognosis must first be reasonably ascertained. Finally, knowing what to expect from the Court process can help a Plaintiff to have reasonable expectations.
